The Accessibility Strengthening Act (Barrierefreiheitsstärkungsgesetz – BFSG), falls under the Federal Ministry of Labor and Social Affairs.
What it includes
The BFSG mandates that a wide range of digital content and services must be accessible to individuals with disabilities, including:
- Web content and applications: Websites and web applications accessible by the public, especially those operated by public authorities, must be accessible.
- Mobile applications: All mobile applications provided for public use, particularly those linked to essential services, must meet accessibility standards.
- Electronically supported administrative processes: This encompasses various processes such as electronic case processing and electronic file management, ensuring digital access to administrative functions and services.
- Graphical program interfaces: Visual components of software interfaces, especially those utilized by public agencies, should support accessible use by people with disabilities.
Exceptions
- Cultural heritage: Digital reproductions from cultural heritage collections are exempt when they cannot feasibly be made fully accessible, recognizing the unique challenges of digitizing historical artifacts and documents.
- Archived content: Digital archives are excluded if they do not contain material required for active administrative tasks or if they have not been updated since September 23, 2019.
- Broadcast content: Content from websites and mobile applications of broadcasters is also outside the scope of mandatory accessibility, allowing flexibility for media-specific services.
Fines and penalties
The BFSG enforces compliance through a system of financial penalties, designed to incentivize adherence to accessibility standards. Depending on the severity and nature of the violation, organizations may face fines ranging from 10,000 euros up to 100,000 euros.
Reporting
Germany follows the EU-wide mandate for accessibility statements on public sector websites and digital services. These statements are essential for maintaining transparency and accountability, and they include:
- Compliance declaration: A summary of the site’s adherence to standards like the Web Content Accessibility Guidelines (WCAG).
- Accessibility features: A listing of the site’s accessible functions, demonstrating how the site supports users with disabilities.
- Contact information: Clear points of contact for user feedback, allowing users to report issues or request assistance.
- Continuous improvement plans: An outline of ongoing efforts to enhance accessibility, reinforcing the commitment to creating inclusive digital environments.
